This Registration Data Access Protocol (“RDAP”) Terms of Service Agreement (the "Agreement") governs the use of the RDAP services provided by [Company Name] ("Provider"). By accessing or using the RDAP services, you agree to be bound by the terms and conditions of this Agreement.
RDAP Services: The registration data access protocol services provided by Provider, including access to domain name registration data.
User:Any individual or entity accessing or using the RDAP services.
3.1 Access: Provider grants User a non-exclusive, non-transferable right to access and use the RDAP services solely for lawful purposes.
3.2 Compliance: User agrees to comply with all applicable laws, regulations, and industry standards in connection with their use of the RDAP services.
4.1 Ownership: Provider retains all right, title, and interest in and to the RDAP services, including all intellectual property rights.
4.2 License: Subject to the terms of this Agreement, Provider grants User a limited, non-exclusive, non-transferable license to use the RDAP services for the duration of this Agreement.
5.1 Privacy: Provider will handle User data in accordance with its privacy policy, which is incorporated into this Agreement by reference.
5.2 Security: Provider will implement reasonable security measures to protect User data from unauthorized access, use, or disclosure.
In no event shall Provider be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with the use of the RDAP services.
Provider may terminate this Agreement at any time without cause by providing written notice to User. Upon termination, User's access to the RDAP services will be immediately terminated.
8.1 Entire Agreement: This Agreement constitutes the entire agreement between Provider and User regarding the RDAP services and supersedes all prior agreements and understandings.
8.2 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.
8.3 Amendment: Provider may amend this Agreement at any time by providing notice to User. User's continued use of the RDAP services after such amendment constitutes acceptance of the amended terms.
